Dapper Dan of Harlem, LLC (“DDH”, “we”, “us”, or “our”) is strongly committed to protecting your privacy and values the relationship we have with you. This Privacy Policy describes our privacy practices with respect to information collected through our Sites, applications, the various social networking platforms we use, and any other online service that links to this Privacy Policy, including any Sites and online services we operate or authorize on behalf of our sites (collectively referred to as the “Sites”). This Privacy Policy does not apply to information that you may provide to us other than through our Sites, such as over the phone, by mail, or in person unless expressly indicated by us (e.g., by including a link to this Privacy Policy).

TYPES OF INFORMATION THAT WE COLLECT

The information collected when you interact with our Sites falls into two categories: (1) Personal information you voluntarily provide such as your name, address, email address, and credit card number; and (2) non-personal information collected through technology, which includes tracking information collected by us as well as third parties. If you make a purchase through our Sites, we may also collect your telephone number.  By providing information to us, you agree to our collection and use as described in this Privacy Policy.

We also may use third-party Sites analytics tools that collect information about visitor traffic on our Sites. The types of automated information we may obtain here include but are not limited to: (i) IP address, device type, browser and operating system type; (ii) search terms used to connect to our Sites; (iii) dates and times of visits; (iv) page views and site navigation patterns; geo-location information; and (v) links and URLs that refer visitors to our Sites.

INFORMATION SHARING OPTIONS

We offer you certain choices about the collection, use and sharing of your information. Withdrawing your consent to use your personal information may mean that you cannot take advantage of certain offerings or Sites features.

Marketing Communications – You may choose not to receive marketing email communications from us by clicking on the unsubscribe link in the marketing emails.

Data Analytics – A cookie will be set on your browser that instructs this technology not to start for that session. Please note that the next time you access the Sites the analytics will be reactivated, so you will have to disable the technology each time. If you reject the cookies and web-beacons we use, you may still use certain aspects of the Sites, but you will not be maximizing the value of the Sites.

Targeted Advertising – If you do not wish to have us collect, use and share information about you to deliver targeted online advertising in this manner, please refer to the following address: http://www.networkadvertising.org/choices/, and follow the instructions of how to opt-out. Please also note that most opt-out mechanisms are cookie-based and will only affect the specific computer and browser that is used to submit an opt-out request. If you have multiple computers or change computers, or use multiple browsers, you will need to submit opt-out requests for each such computer or browser. In addition, if you delete, block or otherwise restrict cookies, you will need to renew your opt-out choices to ensure that any opt-out cookies remain effective.

Cookies – Most browsers will tell you how to stop accepting new cookies, how to be notified when you receive a new cookie, and how to disable existing cookies. Please note, however, that without cookies you may not be able to take full advantage of all of the features on the Sites. In addition, disabling cookies may cancel opt-outs that rely on cookies, such as web analytics or targeted advertising opt-outs.

Do Not Track – Some browsers offer a “Do Not Track” feature that allows you to tell Sites that you do not want to have your online activities tracked. We do not respond to these “Do Not Track” signals.

Third Party Data Collection – We permit third parties to place cookies through our Sites to provide us with better insights into the use of our Sites or user demographics or to provide relevant advertising to you. These third parties may collect information about a consumer’s online activities over time and across different Sites when he or she uses our Sites.

HOW WE USE YOUR INFORMATION

We may use the information that you provide us or that we obtain about you for a variety of business purposes in our legitimate interests, including the following: (i) to manage and maintain the products and services you request on the Sites; (ii) process and track your purchases; (iii) contact you about your orders and your account, and contact individuals (for example, send-a-friend communications) at your request and on your behalf; (iv) maintain a record of the purchases you make on our Sites; (v) communicate with you about our Sites, products, services, offers and events, provided you have given your consent if required under local law; (vi) have our customer support team respond to your questions and comments; (vii) operate, evaluate and improve our Sites; (viii) send marketing communications, including newsletters , offers, and promotions and track industry standard performance metrics, such as email opens and clicks; (ix) serve you targeted advertising, both on our Sites and elsewhere online, based on information we previously collected from you, including your activity on the Sites or activity on third party sites and applications; (x) administer contests, sweepstakes, promotions, and surveys; (xi) prevent fraud and unauthorized transactions and identify potential hackers and other unauthorized users; (xii) enforce our Terms of Use; and (xiii) comply with legal requirements, industry standards and our policies.

We may combine the information we collect with publicly available information and information we receive from our business partners and other third parties. We may use that combined information to enhance and personalize your shopping experience with us, to communicate with you about products, services and events that may be of interest to you, for other promotional purposes and for other purposes described in this section.

WHO WE SHARE INFORMATION WITH

We may share the personal information that you provide to us, and the information that we collect about you to support our business interests as described above, to others, such as to (i) merchant partners so that they might provide fulfillment and payment processing services and customer support services to fulfill your purchase(s) and handle any issues with our services; (ii) technical service providers to keep our site running and safe as well as make our services available; (iii) third party applications such as social media that you use to log into the Sites; (iv) analytics service providers to ensure site functionality and enable data-driven business decisions; (v) comply with the law, applicable regulations, governmental and quasi-governmental requests, court orders or subpoenas, to enforce our agreements or to protect our rights, property or safety or the rights, property or safety of our users or others; or (vi) marketing or advertising service providers and networks to send marketing communications as well as serve you ads tailored to your interests or to tailor ads that may be served to you on our Sites, as well as other Sites and on social media networks. You may see certain ads on other Sites because we participate in advertising networks. Ad networks allow us to target our advertising to users through demographic, behavioral and contextual means. These networks track your online activities over time by collecting information through automated means, including the use of cookies, web-beacons and other methods. The networks use this information to show you advertisements that are tailored to your individual interests. The information that our ad network vendors collect includes information about your visit to the Sites as well as pages you have viewed, and the actions you have taken on the Sites.

We also reserve the right to transfer personal information we have about you in the event we sell, merge or transfer all or a portion of our business or assets. Following such a sale, merger or transfer, you may contact the entity to which we transferred your personal information with any inquiries concerning the processing of that information.

Occasionally, we provide our postal mailing list (consisting of customer names and postal mailing addresses, but not email addresses) to other companies for purposes of marketing the Sites or other products or services that may be of interest to you. In order to determine the information that may be of interest to you, the information that you give us and information about your order may be combined with other personally identifiable information (such as demographic information and past purchase history) available from our records and other sources.

We also use non-personally identifiable information in the aggregate so that we can improve our Sites and for business and administrative purposes. We may also use or share with third parties as listed above for any purpose aggregated data that contains no personally identifiable information.

SOCIAL MEDIA

Our Sites may provide you with the ability to register, log into, “like” or otherwise interact with third party social media services, including, but not limited to, Facebook, Instagram, Twitter, Pinterest, YouTube, and other social media services. These features may enable integration and/or access to your social media accounts. We do not control these social media services or your profiles on these services, and we do not establish privacy settings or rules for how your personal information on these services will be used. If you choose to log on to or submit information through any of these social media services, your personal information will be subject to the applicable social media service’s terms and conditions and your current privacy settings on such social media service. By accessing any social media service, you will be assuming the risk that the personal information you provide on that service may be viewed and/or used by third parties for any purpose. You agree that we are not responsible for any acts or omissions by these social media service providers.

In addition, by choosing to log in to our Sites using your credentials from a social media service, you are asking that service to send us certain information from your account with the service, and you authorize us to collect, store and use such information in accordance with this Privacy Policy.

WHERE WE STORE YOUR PERSONAL INFORMATION

The personal information that you provide to us is generally stored on servers located in the United States. If you are located in another jurisdiction, you should be aware that once your personal information is submitted through our Sites, it will be transferred to our servers in the United States, where laws regarding data protection may be less stringent than the laws in your country. By using our Sites and by providing any personal information through our Sites, all users, including without limitation users in the European Union, fully understand and unambiguously consent to the collection and processing of such personal information in the United States.

CHILDREN’S PRIVACY POLICY

DHH respects the privacy of children and we are committed to complying with the Children’s Online Privacy Protection Act (COPPA). This Children’s Privacy Policy describes our practices with respect to the collection of personal information from children under the age of 13. This Site does not knowingly collect, use, or disclose personal information from children under the age of 13 without prior parental consent, except as permitted by COPPA.

We do not require children to share any personal information in order to participate on this Site. On occasion, however, we may collect personal information, such as an email address from a child as part of an activity (i.e., respond to an email inquiry, send-a-friend communication, email newsletters, and contests/sweepstakes), in accordance with COPPA.

We may also collect anonymous information automatically from your child’s computer or device, such as the frequency with which the child visits our Site and the pages visited, to support the internal operations of the Site. We collect this information so we can understand and monitor usage of the Site, customize content on the Site and improve the performance of the Site. This information is collected using technologies such as cookies, web beacons, flash cookies and similar technologies.

LINKS TO 3rd PARTY SITES

Our Sites may contain links to Sites operated and maintained by third parties, over which we have no control. Privacy policies on such linked Sites may be different from our Privacy Policy. You access such linked Sites at your own risk. You should always read the privacy policy of a linked Sites before disclosing any of your information on such Sites.

HOW LONG WE STORE YOUR PERSONAL INFORMATION

We retain your personal data while your account is in existence or as needed to provide you our services and for legitimate and essential business purposes, such as maintaining the performance of DHH, making data-driven business decisions, complying with our legal obligations, and resolving disputes. If you request, we will delete or anonymize your personal data so that it no longer identifies you, unless, we are legally allowed or required to maintain certain personal data, including (without limitation) situations such as the following:

–  If there is an unresolved issue relating to your account, such as an outstanding credit on your account or an unresolved claim or dispute we will retain the necessary personal data until the issue is resolved;

– Where we are required to retain the personal data for our legal, tax, audit, and accounting obligations, we will retain the necessary personal data for the period required by applicable law; and/or,

– Where necessary for our legitimate business interests such as fraud prevention or to maintain the security of our users.

SECURITY

We maintain physical, electronic, and procedural safeguards to protect the confidentiality and security of information transmitted to us. All credit card numbers submitted to the Sites are encrypted using Secure Sockets Layer (SSL). SSL encrypts your credit card number, name and address so only we are able to decode your information. Unfortunately, however, no data transmission over the Internet can be guaranteed to be 100% secure. As a result, while we strive to protect your contact information, to the extent permitted by law, we do not guarantee or warrant the security of any information you transmit to or from our Sites, and you do so at your own risk.

To prevent unauthorized access, maintain data accuracy, and ensure the correct use of information, we have put in place appropriate physical, electronic, and administrative procedures to safeguard and secure the information we collect online.

ACCESSING AND UPDATING YOUR PERSONAL INFORMATION

We will take commercially reasonable steps to implement your opt-out requests promptly, but you may still receive communications from us as we process your request. If you believe other personal information we maintain about you is inaccurate, you may request that we correct or amend the information by contacting us at [email protected] with the subject line “Update Account Information” and your request in the body of your email. While we make efforts to accommodate requests to restrict our use of your information, we reserve the right to delete all or any portion of customer information if we are not able to reasonably accommodate a requested restriction.

TRANSFER OF PERSONAL INFORMATION TO U.S.

If you are located outside the United States, you should be aware that your personal information  may be transferred to and processed in the United States, the laws of which may have different levels of privacy protection from your country. By using our Sites, you thereby consent to the general use of your information as provided in this Privacy Policy and to the transfer of that information to, and processing and storage of that information in, the United States.

PRIVACY POLICY CHANGES

If we decide to change this Privacy Policy, we will post the revised Privacy Policy here so that you will always know what information we gather, how we might use that information and whether we may disclose it to anyone. Your continued use of the Sites indicates your consent to the Privacy Policy as posted.

EMAIL NEWSLETTERS OPT-OUT

You may always opt-out of receiving future commercial emails and newsletters from DHH. We provide you with the opportunity to opt-out of receiving such communications from us by clicking on the “unsubscribe” link within the email you receive. Please note that your request not to receive unsolicited commercial emails from us will not apply to messages that you request or that are not commercial in nature. For example, we may contact you concerning any purchases you have made with us, even if you opt out of receiving unsolicited commercial messages.

CALIFORNIA PRIVACY RIGHTS

If you are a California resident, California Civil Code Section 1798.83 permits you to request information regarding the disclosure of your personal information to third parties for their direct marketing purposes. GOVERNING LAW

These Sites are published in the United States. We attempt to protect the personal information of all users of our Sites and we attempt to comply with local data protection and consumer rights laws to the extent they may apply to PRH’s services, but our family of Sites are located and targeted to United States citizens and our policies are directed at compliance with those laws. If you are uncertain whether this Privacy Policy conflicts with the applicable local privacy laws where you are located, you should not submit your personal information to DHH.

ASSIGNMENT

We may change our ownership or corporate organization while providing the Sites. We may also sell certain assets associated with the Sites. As a result, please be aware that in such event we may transfer some or all of your information to a company acquiring all or part of our assets or to another company with which we have merged. Under such circumstances we would, to the extent possible, require the acquiring party to follow the practices described in this Privacy Policy, as it may be amended from time to time. Nevertheless, we cannot ensure that an acquiring company or the merged company will have the same privacy practices or treat your information the same as described in this Privacy Policy.
